Terms of Service

1. Acceptance of Terms

By accessing or using HitFactor ("the platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the platform. These Terms constitute a legally binding agreement between you and HitFactor. We reserve the right to modify these Terms at any time; material changes will be communicated via email or a prominent notice on the platform at least 14 days before taking effect.

2. Eligibility and Account Registration

You must be at least 18 years old to create an account, or between 14 and 18 with verifiable parental or guardian consent. By registering, you represent that your information is accurate and complete, and you agree to keep it up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized access. We are not liable for losses caused by unauthorized use of your account where you have failed to safeguard your credentials.

3. Platform Services

HitFactor provides tools for managing shooting competitions, recording scores, generating leaderboards, managing clubs, and tracking training progress. The platform supports multiple shooting disciplines including IDPA, IPSC (Handgun, Rifle, PCC), Shotgun Challenge, and Bullseye. We may add, modify, or discontinue features at any time, with reasonable notice for significant changes.

4. Acceptable Use

You agree to use the platform only for its intended purposes and in compliance with all applicable laws. You must not:

Submit fraudulent, fabricated, or intentionally inaccurate scores or match data.

Impersonate another user, match official, or organization.

Attempt to interfere with, disrupt, or overload the platform's infrastructure.

Reverse-engineer, decompile, or attempt to extract the platform's source code.

Use automated tools (bots, scrapers) to access the platform without prior written permission.

Use the platform to promote violence, harassment, discrimination, or any unlawful activity.

5. Match and Score Data

Match directors are responsible for the accuracy and integrity of match data they create, import, or approve. This includes match details, stage configurations, participant registrations, and final scores.

Scores submitted through the platform become part of the public match record and are visible on leaderboards. Match directors can correct scores through the platform's audit system, which maintains a full history of changes for transparency.

The platform facilitates score recording and calculation but is not a governing body. HitFactor is not liable for scoring errors, match disputes, or decisions made by match officials.

6. Subscriptions and Payments

Some features require a paid subscription. The platform offers multiple tiers (Free, Basic, Pro, Club, Enterprise), each with defined feature limits. Current pricing and features are displayed on our Pricing page.

Subscriptions are billed monthly in EUR and processed through Stripe. By subscribing, you authorize recurring charges to your payment method. Prices may change with 30 days' notice; existing subscribers will be notified before any price increase applies to their account.

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. We do not provide prorated refunds for partial billing periods. Refunds for other circumstances are handled on a case-by-case basis; contact us within 14 days of the charge.

If a payment fails, we may retry the charge and/or suspend access to paid features until payment is resolved.

7. Clubs

Club owners are responsible for managing their club's membership, content, and activities on the platform. The platform provides tools for club management but does not assume responsibility for club operations, membership decisions, internal disputes, or the conduct of club members. Club owners must ensure that their club's activities comply with these Terms and applicable local laws.

8. User Content

You retain ownership of the content you submit to the platform (profile information, match data, training logs, feedback, and club content). By submitting content, you grant HitFactor a worldwide, non-exclusive, royalty-free license to use, display, store, and process this content as necessary to provide and improve the platform services.

You represent that you have the right to submit any content you provide and that it does not infringe on third-party rights. We reserve the right to remove content that violates these Terms or applicable law.

9. Intellectual Property

The platform — including its design, code, branding, logos, and documentation — is the intellectual property of HitFactor and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works from any part of the platform without prior written permission. The HitFactor name and logo are trademarks of HitFactor.

10. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or secure, or that any defects will be corrected. You use the platform at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, HitFactor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the platform, including but not limited to loss of data, loss of revenue, or loss of opportunity, regardless of the cause of action or theory of liability. Our total aggregate liability shall not exceed the total amount you have paid to HitFactor in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless HitFactor and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

13. Termination

You may delete your account at any time through your profile settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Anonymized competition records may be retained as part of the historical match record.

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. We will provide notice where practicable. Upon termination, your right to use the platform ceases immediately. You may request export of your data prior to account deletion.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions. If you are a consumer in the European Union, you also benefit from any mandatory provisions of the law of the country in which you reside.

In the event of a dispute, we encourage you to contact us first at support@hitfactor.app to seek an informal resolution. If we cannot resolve the dispute informally within 30 days, either party may pursue formal proceedings.

For EU consumers: you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Any formal legal proceedings shall be brought before the courts of Vilnius, Lithuania, unless mandatory consumer protection laws in your jurisdiction require otherwise.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and HitFactor regarding the use of the platform. They supersede any prior agreements or understandings.
